Harvard constitutional law professor Laurence Tribe has criticized Donald Trump’s arguments against being disqualified from the 2024 election ballot for inciting the January 6, 2021 insurrection. Tribe described these arguments as “absurd.” Trump is currently facing legal challenges in various states, where it is claimed that he should be barred from appearing on their ballots under Section 3 of the 14th Amendment. This section prohibits individuals who engaged in insurrection against the Constitution from holding office. The trial in Colorado began on Tuesday.
During an interview on MSNBC, Joy Reid asked Tribe if Trump’s actions met the standard outlined in Section 3. Tribe responded by stating that the section clearly states that anyone who “engages in an insurrection or rebellion against the Constitution of the United States” is not entitled to hold office again. He emphasized that this applies not only to the government but also to the Constitution itself. Tribe dismissed Trump’s argument that the section applies to others but not to the president as “absurd.” He also criticized Trump’s belief that he did not take the oath mentioned in Section 3, calling it a “ridiculous” argument.
