Prosecutors in Fulton County, Georgia have filed an emergency request for a protective order in the election subversion case after recorded statements made by several defendants as part of their plea deals were made public. The footage, published by ABC News and The Washington Post, shows the four defendants who pleaded guilty being questioned by prosecutors about their involvement in efforts to overturn the 2020 election results. Prosecutors argue that the release of these recordings is intended to intimidate witnesses, subjecting them to harassment and threats before the trial. They are requesting restrictions on how the defendants can disclose the materials. In order to prevent further disclosure, prosecutors have decided not to provide videos of any proffer sessions to the defendants moving forward. Instead, defendants must come to the District Attorney’s Office to view the confidential recordings, but they will be prohibited from creating any recordings or reproductions. Fulton County District Attorney Fani Willis has charged former President Trump and 18 others with conspiring to unlawfully keep Trump in power following the 2020 election. Four of the defendants have already taken plea deals, including attorneys Sidney Powell, Jenna Ellis, and Kenneth Chesebro, as well as bail bondsman Scott Hall. These defendants have sat down with prosecutors in recorded sessions and agreed to testify truthfully against the remaining co-defendants, who have all pleaded not guilty. During their sessions, Ellis and Powell provided details about conversations they had regarding Trump’s refusal to leave office and the potential appointment of Powell as special counsel to investigate election fraud. The release of these recordings has sparked responses from both sides, with Giuliani’s political adviser arguing that Powell’s statements clear Giuliani of any involvement in the conspiracy. The trial continues to unfold, with further developments expected in the coming weeks.
