Steve Bannon’s lawyer argued before a federal appeals court on Thursday that his client should not be sent to jail for contempt of Congress. The lawyer, David Schoen, aimed to overturn the district court’s decision to sentence Bannon to four months in prison, according to a report by The Hill. Schoen claimed that Bannon was simply following the advice of his counsel when he chose to disregard subpoenas from the House Jan. 6 Committee. The counsel allegedly informed Bannon that he did not have to comply with the subpoenas due to presidential privilege. However, the three-judge panel of the appeals court seemed skeptical of Schoen’s argument, stating that the issue of privilege was not particularly relevant to the appeal and would not necessarily have allowed Bannon to ignore the subpoenas. Although Bannon was initially required to report to prison in November, his sentence has been postponed pending the outcome of his appeal.
