Grimes, whose real name is Claire Boucher, has hired individuals to locate her former partner, Elon Musk, in order to serve him with custody papers for their three children, according to court documents obtained by Insider. Grimes is seeking physical custody of the children, claiming that Musk currently has custody of their three-year-old son, X Æ A-XII, against her wishes. This lawsuit comes shortly after Musk filed a lawsuit of his own to establish the parent-child relationship with his children. Grimes’ legal team made several attempts to serve Musk with the papers, including delivering them to workers at Musk’s businesses and staff at a property associated with him. However, Musk has not yet formally responded to the lawsuit. Grimes’ lawyers argue that their attempts to serve Musk were reasonable given the circumstances. Christopher Melcher, a family law attorney, stated that substitute service is acceptable when direct service is not possible, especially for individuals who are rich or famous. Despite the challenges in serving Musk personally, Grimes’ lawyers claim that he was served through substitute service and that the custody papers were also mailed to him. The next step in the case is likely a motion from Musk arguing that the custody case should be held in Texas, where he initially sued Grimes, rather than California. Musk and his legal team have not responded to requests for comment. Grimes and Musk were in an on-and-off relationship since 2018 and have three children together.
