Kerala Woman Sentenced to 40 Years in Prison for Allowing Sexual Abuse of Her Minor Daughter by Two Partners

A woman in Kerala has been sentenced to 40 years of rigorous imprisonment and fined Rs 20,000 in a case under the Protection of Children from Sexual Offences Act (POCSO). The incident occurred between March 2018 and September 2019, when the accused, who had left her mentally ill husband, was living with her lover named Shishupalan. During this time, Shishupalan brutally abused the woman’s minor daughter multiple times, causing injuries to her private parts. The mother would repeatedly take the child to Shishupalan’s house, where he would assault her in her presence.

When the victim’s eleven-year-old sister returned home, the abused child confided in her about the abuse. The elder sister had also been abused by Shishupalan, but both children were too scared to disclose the information due to his threats. Eventually, the elder sister managed to escape with the younger child and seek refuge at their grandmother’s house. The grandmother learned about the incident and immediately moved the children to a children’s home.

During counseling at the children’s home, the victims revealed the horrifying abuse they had endured. The case was brought before the court, and RS Vijay Mohan, the Special Public Prosecutor, stated that the mother had been convicted for the sexual and brutal abuse of her two daughters by her lovers. The accused’s original husband is a mentally ill patient, which led her to leave her home and stay with the two lovers.

Mohan further explained that the first lover, Shishupalan, had abused the victim when she was just seven years old and studying in first grade. The victim had confided in her mother about the incident, but the accused took no action and even facilitated the other lover’s abuse of the child. Judge R Rekha, in her ruling, found the accused to be a complete disgrace to motherhood and deemed her undeserving of any mercy, resulting in the maximum sentence being imposed.

The case involved the examination of twenty-two witnesses and the submission of thirty-three documents. This news article is published from a syndicated feed and has not been edited by NDTV staff, except for the headline.
