Nebraska Pool Company Accused by State AG of Charging Exorbitant Amounts and Abandoning Homeowners with Unsightly, Massive Holes

A lawsuit filed by Nebraska’s attorney general alleges that Premier Pools and Spas, a local pool installation company, left multiple customers with unsightly and dangerous pits in their backyards. The company would collect 95% of the payments for the pools and then disappear without completing the projects. Customers, who had paid up to $133,000, were left with “ugly gaping holes in their yards,” according to the lawsuit.

At least five homeowners in Nebraska have fallen victim to Premier Pools and Spas’ alleged scheme. The lawsuit claims that the company swindled customers and left them with dirt piles, damage to decks and patios, protruding rebar, and stagnant water in the unfinished mud pits. To make matters worse, Premier Pools attempted to silence customers by illegally preventing them from leaving online reviews and complaints.

The lawsuit emphasizes that these customers deserve their money back and should not have to live with dangerous and unsightly holes in their yards. According to the attorney general, Premier Pools would require customers to pay 45% of the total bill upfront and then dig a hole in their yards. However, the company would refuse to continue construction until customers paid another 50% of the bill. Once customers made the additional payment, Premier Pools would stop responding to their calls and texts.

The lawsuit also reveals that customers lost significant sums of money ranging from $76,000 to $133,000 due to Premier Pools’ deceptive practices. In addition to incomplete pools, the attorney general’s office found instances where the company completed pools that were unsafe or unusable. As a result, customers had to hire other companies to finish or fix the subpar work.

Furthermore, the lawsuit casts doubt on Premier Pools’ legitimacy as a pool builder. The company’s website features pictures of luxurious outdoor pools, but according to the lawsuit, not a single photo depicts Premier Pools’ work. Instead, the company allegedly used images from third-party manufacturers and other pool installation companies.

Premier Pools’ actions have prompted numerous complaints from swindled customers and contractors desperate to recoup their losses, the lawsuit claims. In one instance, the company refused to complete a customer’s pool after learning about a complaint filed with the attorney general’s office.

When contacted for comment, a representative from Premier Pools declined and promptly hung up when asked to speak to the company’s owner.

The lawsuit also highlights an illegal gag clause included in Premier Pools’ contracts. This clause stated that the contract would be terminated if customers posted social media reviews or sought assistance from the Better Business Bureau without giving Premier Pools an opportunity to resolve the issue.

The attorney general’s office hopes to hold Premier Pools accountable for its actions and ensure that affected customers receive the refunds they deserve.
