The Supreme Court has instructed activist Teesta Setalvad and her husband Javed Anand to cooperate with the Gujarat Police in an ongoing case involving alleged misappropriation of funds. In response to the lack of cooperation from the couple, a three-judge bench led by Justice SK Kaul issued the directive. The bench, also comprising Justices Sudhanshu Dhulia and PK Mishra, stated that while no charge sheet has been filed yet, the respondents must cooperate with the investigation when required.
Additionally, the Supreme Court addressed a plea by Ms Setalvad seeking the removal of remarks made by the Gujarat High Court in its previous judgement granting her anticipatory bail on February 8, 2019. The bench clarified that observations made during the bail stage have minimal impact on the trial, and therefore, no further action was necessary. As a result, Ms Setalvad’s anticipatory bail was made absolute.
The case revolves around allegations that Ms Setalvad and Mr Anand fraudulently obtained grants amounting to Rs 1.4 crore from the Indian government between 2008 and 2013 through their NGO, Sabrang Trust. The complaint was filed by the Ahmedabad Crime Branch.
